This GENERAL TERMS AND CONDITIONS control the purchase of products through the website https://www.storececotec.com/es/ managed by CECOTEC INNOVACIONES S.L. (hereinafter CECOTEC) and are intended to define the rights and obligations applicable to the purchase contract agreed between the Client and CECOTEC.

 

Consumer rights are covered by the laws and other consumer protection regulations of the Customer country of habitual residence. Therefore, among others, the periods relating to the legal guarantee of the product and those relating to the alleged of lack of conformity that appear in these General Terms and Conditions are only applicable to deliveries of orders made in Spain. For orders placed through the website and delivered to countries other than Spain, the different terms and conditions provided for in Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods, amending Regulation (EC) No 2017/2394 and Directive 2009/22/EC and repealing Directive 1999/44/EC, as well as any applicable state legislation, shall apply.

 

CECOTEC, in compliance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, informs the Client that:

These General Terms and Conditions are formulated in accordance with the provisions of Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods, Law 7/1996, of 15 January, on the Regulation of Retail Trade, Law 7/1998, of 13 April, on General Business Terms and Conditions, Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 16/2011, of 24 June, on Consumer Credit, and the Civil and Commercial Codes (Spanish laws) and other applicable regulations.

 

This online store is intended solely for consumers - natural or legal persons acting outside their trade, business, craft or profession - (hereinafter referred to as the Customer). Only consumers may claim the rights provided for in these General Terms and Conditions and other rights recognised by consumer protection legislation.

 

These General Terms and Conditions shall not apply to the sale and purchase of CECOTEC branded products made through other online or offline stores.

 

 

  1.                      PURCHASE AND/OR CONTRACTUAL PROCESS

 

In order to make any purchase on the CECOTEC website, the Customer must be at least 18 years of age and must register as a user through https://www.storececotec.com/es/, in which they will fill in a data collection form with the contracting necessary information. The Consumer identity data must be complete, accurate and truthful.

In order to complete the registration process, the Client, having been informed of their rights regarding the processing of the data provided, must expressly consent to the processing of this data by accepting the CECOTEC Privacy Policy.

 

The effective purchase of any of the products offered on the CECOTEC website entails the acceptance of the General Terms and Conditions indicated here, as well as the acceptance of the Special Conditions that may be applicable to the purchase of certain products and which are also made known to the Customer in the pre-contractual information published prior to purchase.

 

The language used in the contract is English.

 

The Customer will receive the Order Confirmation by e-mail and will have the complete details of the order placed available for download in the section of the website called ‘My Account’. They can also request an electronic invoice in this section. To access ‘My account’, the Consumer must log in to the website.

 

CECOTEC may modify the content of these General Terms and Conditions at any time, so it is advisable to read their content each time before making a new purchase. The modification of the General Terms and Conditions shall not affect purchases of products made prior to the modification, and the General Terms and Conditions at the time of the formalisation of the contract shall apply to such purchases.

 

 

  1.                    COMMUNICATION WITH CECOTEC

 

The Customer may communicate with CECOTEC through the Customer Service telephone number + 34 963 2107 28, from Monday to Friday from 9:00 to 18:00 hours.

 

In addition, the Consumer can contact CECOTEC through the ‘CECO CARE’ Consumer Site: https://www.cecocare.com, a platform in which the Consumer will be able to process incidents, as well as exercise the legal guarantee of the products, request technical assistance, returns, after-sales services, etc.

 

In the same manner, they have at their disposal the customer service form in the information section of our website, through which they can make queries regarding the status of their order, invoicing, returns, shipments, incidents, etc.

 

 

  1.                  PRODUCTS

 

The products offered and their main features, as well as functionalities, are in https://www.storececotec.com/es/, along with the product description, composition and more detailed information. Photographs and in most cases also illustrative videos are shown for each product.

 

CECOTEC may, at any time, add new products to those offered or withdraw from sale any product offered, except those that included in special promotions with a determined duration.

 

CECOTEC seeks at all times to guarantee the availability of all products offered for sale through the website. However, in the event that any product purchased, due to exceptional circumstances, is not available and cannot be delivered on the delivery date initially agreed, the Customer will be informed of the new expected delivery date, and will have the possibility of cancelling the order and obtaining a refund of the total price paid, without undue delay. However, in the event that the product is not available and is not expected to be restocked, the Customer shall be informed of this and the order shall be cancelled by CECOTEC, so that the Customer shall obtain a refund of the total price paid without undue delay.

Furthermore, if the product is not available, CECOTEC may choose to supply a product with similar or superior characteristics with no increase in price. With regard to this product, the Customer may exercise their right of withdrawal and cancellation under the same terms as if it were the initially purchased good.

 

In the event of cancellation of the order, the corresponding reimbursement will be made by the same means of payment used by the Customer to purchase the goods, without prejudice to the rights of the Customer as a consumer.

 

 

  1.                 PRICES,  CHARGES AND TAXES

 

The prices (RRP) of each of the products offered for sale are expressed in euros, and, where applicable, it is expressly indicated if it is subject to any offer. The prices of the products may, with the exception of sales promotions of a fixed duration, vary at any time. Price changes will not affect orders already placed.

 

In the case product packs or batches, the customer has the information regarding both the price of the pack and the price of the products separately.

 

-          The prices (RRP) include taxes (VAT).

-          Shipping costs: if any, shall be borne by the Customer. Shipments to mainland Spain and the Canary Islands will be free of charge (provided the basic delivery method is chosen by the Customer), while shipments to the Balearic Islands will cost €10 per shipment. Deliveries to European Union countries will have a cost of between €5 and €25, which will be notified to the Customer prior to the completion of the purchase process.

-          For the fitness and relax range products, the ‘home delivery’ option can be selected for an additional cost of €49.90. The product will be delivered at home as long as there is a lift. This service does not include the assembly.

-          For products in the ‘household appliances’ range (washing machines, washer-dryers), the price (RRP) includes delivery, installation and removal of the old appliance.

 

In any case, the final cost of the purchase will be indicated to the customer in the electronic purchase process before the acceptance.

 

 

  1.                   ORDER DELIVERY INFORMATION

 

SHIPMENTS

  •         Deliveries shall be carried out by an Independent Transport Agency to the address indicated by the Customer at the time of purchase.
  •         Shipping times are 24 to 72 working hours after the order confirmation. In the event of unavailability of the product and delay in the delivery initially agreed, the Customer will be informed of this and will be informed of the new estimated delivery time, in accordance with the above with regard to the possibility of cancellation of the order.
  •         Deliveries are made on working days, from Monday to Friday, excluding Saturdays, Sundays and national and regional holidays.
  •         The delivery time is from 1 to 5 workdays from the time of shipment.

Delivery times will vary according to products, sizes and province of delivery. In the case of towns far from large urban centres or with a population of less than 5,000 inhabitants, delivery may be delayed by 3 to 5 days.

 

Items shall be delivered within the agreed period, unless the customer wishes and formally requests the items to be delivered later than the agreed date. If the Customer wishes to make any changes to the delivery date of the order, this must be notified to CECOTEC prior to the order dispatch.

 

The transport agency in charge of the delivery will contact the Customer beforehand to arrange the delivery. In the event of disagreement with the transport agency, the Customer may contact CECOTEC through the Customer Service telephone number + 34 963 2107 28 to help with management.

 

Occasionally, for reasons beyond the company control, the delivery date may be delayed by 2 working days. In such case, the customer may cancel the order if it has not yet been dispatched and receive the amount paid without undue delay. Once shipped, the Customer may refuse the order by stating this on the delivery note of the transport company, and once the product has been received at CECOTEC, the total amount paid will be refunded to the Customer without undue delay. The refund will be made through the same method of payment used by the Customer, without prejudice to the rights of the Customer as one. CECOTEC shall under no circumstances be held responsible for any failure to meet delivery deadlines if the delivery has not been delayed due to the Customer own will or cause or if the Customer cannot be located by means of the data provided.

 

Without prejudice to the rights offered to consumers by Spanish legislation, CECOTEC shall not be liable for delays or failures in the shipment and delivery of products when extreme situations occur that make it impossible to make deliveries and distort or interrupt the normal operation of public services, infrastructures and communication systems, and/or the transport of goods and people such as acts of civil commotion, natural disasters, critical health situations or any other extraordinary factor.

 

The order shall be considered delivered when the carrier has delivered the package to the Customer. It is the responsibility of the Customer or, where applicable, the person delegated by the Client to deliver the product, to check the condition of the goods at the time of receipt and to indicate any anomalies detected in the external or internal packaging on the delivery note.

 

GOODS VERIFICATION

 

Si se comprueba por el Cliente que la mercancía ha llegado golpeada, con daños visibles en su embalaje exterior o interior, debe indicarlo en el albarán de entrega de la agencia de transportes y, si posteriormente observa que el producto presenta una falta de conformidad, podrá ponerse en contacto con CECOTEC, con el fin de solucionar la incidencia, a través del teléfono de Atención al cliente + 34 963 2107 28, en horario de lunes viernes de 9:00 a 18:00 horas, o bien gestionar la incidencia a través del Formulario de atención al cliente que aparece en la categoría de información de nuestro sitio web, concretamente en el apartado “incidencias y asistencia técnica”.

 

CECOTEC requests the Customer, if possible, to take photographs of the condition of the product, boxes and labels of the courier company. These images will be used as evidence to prove the condition of the product and to facilitate the different claims.

 

If a third person other than the Customer signs for the receipt of the goods on behalf of the Customer, it is important that the Customer informs the receiving person that the goods must be inspected at the time of delivery and any visible damage must be indicated on the delivery note as described above.


If the damage does not appear on the delivery note and is not reported, CECOTEC will not be able to solve the incident reported by the Customer or make the relevant claims to the Transport Agency. It will be helpful to CECOTEC if the Customer provides photographs of the exterior and interior packaging, of the apparent damage and of the courier label.

 

In addition, CECOTEC advises the Customer to keep the original boxes and packaging of the product until it can be verified that the product received is in perfect condition and that it matches the product purchased. Similarly, the Customer is advised to keep the original packaging of the products in case they wish to withdraw from the contract within the legally stipulated period.


If the Customer has any other type of incident related to the goods received, such as the receipt of only one of several products in the order or of a product other than the one purchased according to the invoice or proof of purchase, etc., they may contact CECOTEC via the Customer Service telephone number + 34 963 2107 28, from Monday to Friday from 9:00 to 18:00 hours, or via the Customer Service Form in the information section of our website, to report the incident and find a solution as soon as possible.

 

 

  1.                 ORDER CANCELLATION
  •         The Customer has the possibility to cancel the order as long as it has not yet been shipped. Once shipped, the Customer may refuse the order by stating this on the delivery note of the transport company and, once the product has been received by CECOTEC, the total amount paid, after deduction of the return costs, shall be reimbursed to the Customer without undue delay and, in any case, within 14 calendar days. Furthermore, the Customer has the option to accept the delivery of the order and to withdraw from the order within 14 calendar days as indicated in section VII of these General Terms and Conditions.
  •         It is important the Customer bares in mind that the shipping times are 24 to 72 working hours after the order confirmation.

 

If the Customer wishes to cancel an order they can do so via the Customer Service telephone number + 34 963 2107 28, from Monday to Friday from 9:00 to 18:00, via the Costumer Site https://support.storececotec.com, or viathe Customer Service form in the information section of our website, in which information regarding the process can be requested.

 

Once the order cancellation request has been processed, the total price paid by the Customer will be reimbursed without undue delay and by the same means of payment used by the Customer at the time of purchase, without prejudice to the rights of the Customer as one.

 

 

  1.                RETURN POLICY.  CHANGE OF MIND.  RETURN COSTS.

The right of withdrawal is the Customer right to cancel the purchase made, in accordance with the provisions of the articles 68 and 102 and following the articles of the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

The Customer has the right to withdraw from the contract within 14 calendar days from receipt of the order, without stating the reason and without incurring any costs, except those provided for in art. 107.2 and 108 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, including the costs of return and the costs of the delivery method chosen by the Customer (‘home delivery’) that exceed the cost of the ordinary delivery method.

The withdrawal period is extended until 20 January 2022 for any product (whether or not subject to special offer) purchased and delivered between 1 November 2021 and 6 January 2022.For all purchases made on or after 6 January 2022, as well as for purchases made between 1 November 2021 and 6 January 2022 and delivered after 6 January 2022, the standard returns policy will apply.

The withdrawal shall be exercised according to the following conditions:

-          The Customer shall have a period of 14 days to exercise the right of withdrawal from the delivery of the product, simply by informing CECOTEC of their decision through any of the channels established for this purpose.

-          To process the cancellation, the Customer can do so by calling the Customer Service telephone number + 34 963 2107 28, from Monday to Friday from 9:00 to 18:00, via de Customer Site https://support.storececotec.com or via the online withdrawal form that can be filled in from the website. Once requested, CECOTEC will acknowledge receipt and provide the Customer, in the e-mail indicated in the purchase process, with a return registration number and, unless the Customer indicates that they wish to send the product themselves, CECOTEC will arrange for the product to be collected from the address where it was delivered. In the event that the Customer notifies that the collection must be made at a different address, the Customer will be informed of the additional cost of return, if any, that may be incurred.

-          In both cases, CECOTEC will provide the Customer with a label or a package identification code to be sticked or indicated on the exterior of the packaging with the information related to the shipment.

-          The Customer must return the product in good condition, i.e. it must not be incomplete, damaged or soiled and must be delivered with the instructions and other accessories that were originally delivered with the product.

-          It is recommended that the Customer returns the product in its original packaging. If they no longer have the original packaging, they may return the product in any other packaging, provided that it is properly sealed to prevent the product from being lost and protected to prevent damage, otherwise the product may suffer damage. In the event of damage, once the product has been received and checked, the Customer shall be informed of the amount of such damage and it shall be retained and, where applicable, deducted from the total amount to be reimbursed.

-          In the event that the Customer exercises the right of withdrawal, the direct costs of returning the goods will be deducted from the amount to be refunded. These return costs are:

(i)                  €60.00 for products from the Bolero range (washing machines and washer-dryers). The cost includes de-installation and pick-up.

(ii)                 €29.80 for the homologated electric scooter OutSider DemiGod Makalu,

(iii)               €29.80 for all the heavy fitness products. The following shall be considered to be heavy fitness products all the products that are not considered light.

(iv)               €19.32 for light fitness products: X-Bike foldable bicycle, X-BIKE PRO folding bicycle, Runfit Step treadmill - Black series and Runfit Step treadmill - Red series.

(v)                 €10.00 for the other products.

-          CECOTEC shall refund the Customer the full amount paid, after deduction of the return costs, without undue delay and, in any event, no later than 14 calendar days after CECOTEC has been informed of the withdrawal decision. The refund will be made using the same payment method used for the initial transaction, without prejudice to their rights as a consumer.

-          Should the Customer wish to seek any information about the withdrawal and the status of the withdrawal, they may do so via the Customer Service Form in the information section of our website.

-          The customer must consider that, if the product being withdrawn was purchased as part of a two-product pack and has therefore benefited from an offer with each product, it will not be necessary to return all the products from the pack, but in the event that only one of the products is returned, they will be only refunded the difference between the amount paid for the purchase of the pack of products and the purchase price not subject to offer of the non-returned product. To this effect and in order to inform the Customer, the pre-contractual information of the Pack itself will specify the individual sales price of each of the products in it (price per unit) without offer.

The Customer must take into account that there are some products which, by their very nature, have special return conditions: 

 

  1.                      To exercise the right of withdrawal for certain products in the Personal care range, such as hair clippers, shavers, epilators, pedicure, curling irons, straighteners and hairbrushes, the product must be returned in each original packaging and unused, both for health and hygiene reasons, in accordance with article 103, section e) of the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

 

 

  1.              GUARANTEE

 

All products sold from 1 January 2022 onwards are covered by a three-year legal guarantee against non-conformity, in accordance with the provisions of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users.

 

For products purchased prior to this date, the legal guarantee period is two years from the time of delivery and, in relation to the legal guarantee and its exercise, the provisions of the General Law for the Defence of Consumers and Users in its version prior to the amendments introduced by Royal Decree Law 7/2021 of 27 April shall apply.

 

The following conditions shall apply to products purchased on or after 1 January 2022.

 

In the absence of proof to this effect, any lack of conformity which becomes apparent within two years of delivery of the product shall be assumed to have existed at the time of delivery, unless this assumption is incompatible with the nature of the product or the nature of the lack of conformity.

 

Incorrect installation of the goods or incorrect integration of the digital content or services into the consumer digital environment that has been carried out by the Customer in violation of the instructions provided by CECOTEC cannot be considered as a lack of conformity, unless the incorrect installation or integration is due to deficiencies in the instructions provided by CECOTEC.

 

CECOTEC shall be liable to the Customer for any lack of conformity that exists at the time of delivery of the goods and that becomes apparent during the three years following delivery.

 

When a lack of conformity becomes apparent, the Customer shall inform CECOTEC in order to give it the opportunity to restore the conformity of the goods.

The Customer may require CECOTEC, by means of a simple declaration, to remedy this lack of conformity, to reduce the price or to cancel the contract and, in the event of any of these situations, if applicable, to pay damages. The customer shall be entitled to suspend payment of any outstanding part of the price of the goods until CECOTEC has fulfilled its obligation to comply with the goods.

 

The Customer may choose between the repair of the product or its replacement, unless one of these two options is impossible or, in comparison with the other corrective measure, involves disproportionate costs for CECOTEC, both measures being free of charge for the customer. These measures shall be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they are intended.

 

CECOTEC may refuse to comply with the goods when this proves impossible or involves disproportionate costs. In the event that the goods are not compliant within a reasonable time or CECOTEC has declared, or it is clear from the circumstances, that it will not comply within a reasonable time or without major inconvenience to the Customer, the latter may demand a reduction in price or cancellation of the contract, in accordance with the conditions and deadlines set out in the aforementioned Act.

 

To deal with any incident and, where appropriate, to make use of the legal guarantee of the product, the Customer may do so by calling the Customer Service telephone number + 34 963 2107 28, Monday to Friday from 9:00 to 18:00 hours, or via the Customer Site https://www.cecocare.com, as well as via de Customer Service form in the information section of our website, and follow the steps provided, thus placing the goods at CECOTEC disposal so that they can be picked up. When a repair covered by the legal guarantee of the product requires the removal of goods installed in a manner consistent with their nature, the obligation to repair or replace them shall include the removal of the non-conforming goods and the installation of the replaced or repaired goods at CECOTEC expense.

 

The guarantee start date is the delivery date of the product. To exercise the warranty, the Customer must keep the invoice or proof of purchase. The product sent for repair or replacement must match the one sent by CECOTEC, enclosing the invoice or proof of purchase and must be perfectly packaged and protected. If the product arrives at the CECOTEC premises with damage attributable to deficient packaging or protection, the repair may not be covered by the guarantee, and the Customer will be informed accordingly.

 

If, once the product has been picked up and a diagnosis has been issued by the CECOTEC Technical Service, it is determined that the conditions set out in the General Law for the Defence of Consumers and Users are not met (for example, that the defect has been caused by incorrect use of the product, by a circumstance external to the product, previous repair carried out by unauthorised technical services, etc.), CECOTEC will contact the Customer to inform the customer of the nature of the defect and the estimated cost of repair. ), CECOTEC will contact the Customer to inform them of the nature of the defect and the estimated cost of repair. If the Customer requests repair in such a case, the costs of repair shall be borne in full by the Customer. Furthermore, in certain cases, the consumer may be asked to pay the cost of the diagnosis carried out - including the pick-up cost - when no lack of conformity has been detected. The consumer will be informed of the corresponding cost upon delivery of the product so that the problem can be diagnosed. When the legal guarantee does not apply, CECOTEC will ask the Customer to pay the full amount of the budget before proceeding with the repair.

 

Defects caused by improper use or manipulation, connection to the mains other than that specified, incorrect installation or defects resulting from any external cause are excluded from the guarantee. Furthermore, the guarantee does not cover damage caused by external factors such as power ups or downs, short circuits, atmospheric phenomena, fire, water, abnormal use of the product, burns, cuts, scratches, wrinkles, marks or other damage that may be caused by animals, accidental falls or improper use. Claims for natural loss of brightness or degradation of brightness, colour deterioration due to exposure of the product to sunlight or other heat sources, as well as the use or contact with chemical products and treatment with non-indicated cleaning products are exempt from guaranteed coverage.

 

CECOTEC shall not be liable for damages caused by installation not carried out by CECOTEC official technicians, products modified, manipulated or repaired by the customer or by any other person not authorised by CECOTEC when such manipulation or installation is the cause of the non-conformity; as well as for improper use or apparent signs of incorrect treatment. All products sold on the CECOTEC website are for domestic use only and not for industrial, commercial or professional use.

 

CECOTEC is not responsible to compensate the customer or third parties for the consequences of improper use of the product, be it direct or indirect damage, accidents suffered by persons, damage to property other than the product, loss of profit or loss of earnings.


During a repair or replacement of goods with digital content there is a possibility of loss of information. Therefore, CECOTEC shall not be responsible for the loss or recovery nor does CECOTEC guarantee that during the repair process the customer initial setting information will be maintained until delivery, in such cases it will be necessary to re-set the operation and/or wireless connection of the product when it is received.

 

  1.                PAYMENT METHODS

 

The Customer can choose one of the following payment methods:

 

Payment by credit or debit card

Payment can be made immediately through our Bank SSL secure payment gateway. Payment by VISA or MASTERCARD, debit and credit card is accepted.

 

Both personal and banking data will be protected with all the security measures established by the Organic Law on Data Protection 15/1999 and its Development Regulations.

 

If any return or cancellation of the order is necessary, the amount will be refunded to the same payment card, unless the Customer indicates another payment method.

 

Payment by finance company

3x 4x Oney is a payment method that allows you to buy online in instalments. This service is offered by Oney Servicios Financieros EFC, SAU, which is a financial institution registered and supervised by the Bank of Spain under number 8814. Oney allows the Customer to split and finance the cost of the order in instalments quickly, WITHOUT INTEREST.

 

By using 3x 4x Oney the Customer can pay for their purchase in 3, 4, 6, or 10 instalments with their card, as long as the purchase amount exceeds €90 and up to a maximum of €2,500. A minimum fee of €20 and a 0% A.A.R. is established.

 

The payments of the instalments into which the purchase price has been divided shall be made periodically on the card indicated by the Customer when making the purchase.  The first payment will be made at the time of purchase. 

 

This payment method is valid for VISA or Mastercard, debit or credit cards with a validity date longer than the duration of the selected financing method. For example, if six-month financing is requested, the expiry date of the card used may not be less than six months. Prepaid, virtual and American Express cards will not be accepted in this operation. This method is only applicable to natural persons of legal age, residing in Spain.

  1.                  CUSTOMER SERVICE AND CLAIMS

 

To communicate any complaint, claim or incident to CECOTEC, the Customer may contact the Customer Service telephone number + 34 963 2107 28, from Monday to Friday from 9:00 to 18:00.

Furthermore, if the Customer wishes to process an incident or exercise the legal guarantee of their product, they may do so through the Customer Site https://www.cecocare.com.
