CONDITIONS OF USE OF THE WEBSITE

 

I. USERS

This web portal is the property of CECOTEC INNOVACIONES S.L.U. -from now on, the owner- whose identifying data can be found in the Legal Notice section, providing access to a wide diversity of information and services for the sale of small household appliances and articles (from now on, "the contents").

The access and usage of the website assigns the condition of USER. Every user accepts, from the aforesaid access or use, the General Conditions of Use reflected here, as well as the Privacy Policy, assuming the responsibility of the use of the web portal. Users may contact the owner via email or telephone provided on the website, to request commercial information or hire any of the services of the owner. Once such information is requested, they will be informed of the process and the applicable conditions.

The aforesaid Terms and Conditions shall apply regardless of any General Terms and Conditions of Business which may be binding.

II. OBLIGATIONS

The user commits him/herself not to carry out activities contrary to Spanish legislation, especially with regard to actions constituting crimes according to the Penal Code. The user also commits him/herself to act in accordance with these Terms of Use and the Privacy Policy.

The user commits him/herself to:

  • Copying, renting, leasing, distributing or transfering part or all of the rights that the user holds under these Terms of Use.
  • Modifying, copying, reproducing, downloading, disseminating, transmiting, exploiting commercially or distributing in any way the services, the pages of the sites or the computer codes of the elements that make up the services and sites.
  • Assigning the rights or obligations derived from the present Conditions of Use, nor to cede, transfer or sublicense the rights that in its case correspond to him as user of the Web site, unless it has the previous consent and in writing of the holder.

IV. EXCLUSION OF WARRANTIES AND LIABILITY

The holder works to keep the content of the website updated, although it does not guarantee the absence of possible errors or failures of updating, reserving the right to make at any time and without prior notice, changes and updates on the information contained in its portal, configuration or presentation.

The holder will not assume any type of responsibility, directly or indirectly for the fraudulent or illicit use that the user makes of the service, or of the contents lodged in the platform.

The holder will not be responsible in any case for the fact that the contact data necessary for the billing of different products or services that the user contracts through the service are not correct, truthful or not updated.

The holder shall not be liable for any information which has not been produced directly by him. Neither for the improper use of this information and/or contents.

In the event that the user accesses or downloads, directly or indirectly through the website any third parties content, the owner shall not be liable in any case for possible downloads that the user may make from third party sites.

The holder shall not be liable in any case for:

  1. problems of access, availability and continuity of the service, functionalities that make up the service when these problems derive from factors outside the scope of its control and activity.
  2. the existence of computer programs or materials containing any electronic viruses, trojans, worms, harmful code or any other potentially harmful computer file that may cause alterations to the user's computer system and/or mobile terminal.
  3. loss or damages of any kind that may be caused to the user by the interruption, termination or malfunction of the service for reasons not attributable to the owner.
  4. any loss or damages that may be caused to the user as a result of unauthorised access and/or use of his account by third parties.

V. MODIFICATIONS

The holder has the right to carry out without previous notice the modifications that he considers appropriate in his portal, being able to change, to suppress or to add so much the contents and services that are lent through this as the form in which these appear presented or located in his portal.

VI. INTELLECTUAL AND INDUSTRIAL PROPERTY

The holder, by himself or as a transferee or licensee, is the owner of all the intellectual and industrial property rights of the portal, as well as the elements contained therein (by way of example, icons, sound, audio, video, software or texts; brands or logos, combinations of colours, structure and design, selection of materials used, computer programmes necessary for their operation, access and use, etc.). All rights reserved.

On the basis of the provisions of articles 8 and 32.1, second paragraph, of the Law on Intellectual Property, the reproduction, distribution and public communication, including its method of placed at disposal, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorization of the owner, are expressly prohibited.

Users must refrain from removing, altering, circumventing or manipulating any protection device or security system installed on the holder’s pages.

The user may, besides viewing the elements of the website, make impressions, copies or downloads of content, provided that such actions are directed exclusively to their personal and private use.

The user commits him/herself to respect the owner's intellectual and industrial property rights.

In the event that links or hyperlinks to other Internet sites are provided on the Website, the holder shall not exercise any type of control over such sites and content.

Under no circumstance shall the holder assume any responsibility for the contents of any link belonging to a foreign website or guarantee the technical availability, quality, reliability, accuracy, breadth, veracity, validity and constitutionality of any material or information contained in any such hyperlinks or other Internet sites.

The holder warns users that some advertising banners displayed on the website as well as the pages of third parties that are accessed through links may request personal data. These data collections by third parties will be carried out, where appropriate, in accordance with their own privacy policies, which must be previously consulted and accepted by the user. Under no circumstance does the owner access, visualize, store or treat in any way the data that the users provide by these means.

Likewise, the inclusion of these external connections will not imply any type of association, merger or participation with the connected entities.

Hyperlinks to the website in any form and to any page within the website are permitted.

VIII. OVERVIEWS AND MISCELLANY

The holder will chase the breach of these conditions, as well as any misuse of its portal exercising all civil and criminal actions that may correspond in law. The holder reserves the right to exercise all possible actions in accordance with applicable law.

The holder may inform and collaborate in a timely manner with the competent police and judicial authorities if he detects any infringement of the legislation in force or if he suspects a crime or criminal misdemeanour.

In application of the Spanish legislation, the licensee undertakes to carry out this task as diligently as possible in accordance with its technical capabilities.

IX. INFRINGEMENT OF RIGHTS

In the event that any person or entity detects that its contents have been published on this website without their consent, therefore being an infringement of any of their rights, they may communicate it (indicating in the subject or express reference "Infringement of Rights") to the owner by email to the following address:  info@cecotec.es.

The statement should include the following information:

X. SAFEGUARD CLAUSE

Each of the provisions of these Terms of Use and the Privacy Policy, are independent and must be considered one by one, in case that one of them could be considered or declared null, invalid, inapplicable, illegal or unenforceable, in any jurisdiction, will be considered ineffective to the extent appropriate, but this fact will not affect

  • the validity and applicability in such jurisdiction of the remaining provisions of these Terms of Use and Privacy Policy, or
  • the validity and applicability in other jurisdictions of any other provisions of these Terms of Use and Privacy Policy.

XI. APPLICABLE LAW AND JURISDICTION

The present Conditions of Use of the Website are governed by Spanish law. The language in which this legal notice is written and interpreted is Spanish. This legal notice will not be filed individually for each user but will remain accessible via the Internet on this website.

Users who have the status of consumers or users as defined by Spanish law and reside in the European Union, if they have had a problem with an online purchase made to the owner, to try to reach an out-of-court settlement can go to the Online Dispute Resolution Platform, created by the European Union and developed by the European Commission.

Provided that the User is not a consumer or user, and when there is no rule that requires otherwise, the parties agree to submit to the Courts and Tribunals of Valencia, as this is the place of conclusion of the contract, expressly waiving any other jurisdiction that might correspond.
